Texas small-estate procedure
Texas offers a simplified path for smaller estates that meet specific criteria. Used correctly, it saves months and substantial cost. Used incorrectly, it can complicate things if the estate later turns out not to qualify.
What's available
Texas offers a Small Estate Affidavit and Muniment of Title as alternatives to full probate when the estate qualifies.
Muniment of Title is distinctive to Texas and a few other states — it admits the will to probate without appointing an executor when there are no unpaid debts (other than secured real-estate debt).
Common gotchas
The Small Estate Affidavit has narrow eligibility. Confirm before filing — the cost of being wrong is having to start over with full probate.
