California small-estate procedure

California offers a simplified path for smaller estates that meet specific criteria. Used correctly, it saves months and substantial cost. Used incorrectly, it can complicate things if the estate later turns out not to qualify.

What's available

California offers several simplified procedures for smaller estates, including transfer-of-personal-property affidavits and petitions to determine succession to real and personal property below specific value caps.

The dollar caps are revised periodically — confirm the current figure with the court or a probate attorney before relying on the simplified path.

Common gotchas

Real property often kicks the estate out of the simplified track in California unless its date-of-death value is below the threshold for the relevant procedure.

Joint tenancy and community property survivorship may already pass real estate without probate at all.
