Florida probate process
Probate in Florida follows a fairly predictable sequence, even when individual cases vary. Below is the typical shape of a Florida probate from filing through final distribution.
Filing
A petition for administration is filed in the circuit court of the county where the decedent lived. Florida requires the personal representative to be represented by an attorney in most formal administrations.
Letters and notice
The court issues Letters of Administration. Notice to creditors is published, and known creditors are served directly.
Inventory and administration
The personal representative inventories the estate and addresses creditor claims through the statutory window.
Distribution and closing
After debts, expenses, and taxes are paid, the personal representative files a final accounting and distributes the residue. The court then discharges the personal representative.
